Facts: | Ms. Escobedo applied for an “Oklahoma identification card” and presented a Californnia birth certificate and a motor vehicle title. DPS refused to issue an ID card because Ms. Escobedo could not produce a Social Security Number and asserted she was not eligible for a SSN.Ms. Escobedo filed a declaratory judgment action in the district court seeking a ruling that she was not required to provide a SSN to receive an ID card. The District Court dismissed the proceeding, concluding a SSN was required. |

Analysis: | According to the current Regulation, O.A.C. 595:10-1-252 entitled, “Procedure for obtaining an identification card,” there are now two forms of Oklahoma identification: a “Real ID Compliant Identification card” and a “Real ID Non-compliant identification card. Real ID Non-Compliant ID cards do not require the applicant to have or submit a SSN. Ms. Escobedo was entitled to a Real ID Non-Compliant ID card. |
Outcome: | Reversed and remanded. |
